1. Agreement to Terms

Welcome to PickleLobby. These Terms of Service ("Terms") govern your use of the PickleLobby platform, website, and services (collectively, the "Platform") operated by HIRE SOLAH ENTERPRISE(Company No. CT0143106H) ("we," "us," or "our").

By accessing or using PickleLobby, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.

2. Definitions

  • "Platform" refers to the PickleLobby website, mobile applications, and services
  • "User" refers to anyone who accesses or uses the Platform
  • "Player" refers to users who search for and book pickleball courts
  • "Owner" refers to venue owners who list and manage courts on the Platform
  • "Booking" refers to a reservation of a court through the Platform
  • "Venue" refers to a pickleball facility listed on the Platform

3. Eligibility

To use PickleLobby, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate, current, and complete information during registration
  • Not be prohibited from using the Platform under Malaysian law

By using the Platform, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

4.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate information and keep your account details up to date. You are responsible for maintaining the confidentiality of your password and account credentials.

4.2 Account Security

You are responsible for all activities that occur under your account. Notify us immediately at hi@solahidris.com if you suspect unauthorized access to your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

5. For Players: Booking Services

5.1 Booking Process

Players can search for and book available courts through the Platform. By completing a booking, you enter into a direct agreement with the venue owner to use the court at the specified time.

5.2 Payment

Payment for bookings is processed through our payment partners (Stripe, Billplz). You agree to pay all booking fees, service fees, and applicable taxes as displayed at checkout. All payments are final unless specified otherwise in our cancellation policy.

5.3 Service Fees

PickleLobby charges a service fee for facilitating bookings. This fee is clearly displayed before you confirm your booking. Service fees are non-refundable unless the booking is cancelled by the venue owner.

5.4 Cancellations and Refunds

Cancellation policies vary by venue. Generally:

  • Cancellations made 24+ hours before booking: Full refund minus service fee
  • Cancellations made within 24 hours: No refund
  • Venue-initiated cancellations: Full refund including service fee

Specific cancellation policies are displayed on each venue's page and in your booking confirmation.

5.5 Player Conduct

When using venues, you agree to:

  • Arrive on time for your booking
  • Follow venue rules and guidelines
  • Treat venue staff and other players with respect
  • Report any issues or damages immediately
  • Not engage in any illegal, dangerous, or disruptive behavior

6. For Owners: Venue Listing Services

6.1 Venue Registration

Venue owners can register and list their courts on PickleLobby. By listing a venue, you represent and warrant that you have the legal right to operate the venue and accept bookings.

6.2 Venue Information

You must provide accurate, complete, and up-to-date information about your venue, including location, amenities, pricing, availability, and photos. You are responsible for updating this information promptly when changes occur.

6.3 Booking Obligations

As a venue owner, you agree to:

  • Honor all confirmed bookings
  • Maintain accurate availability calendars
  • Provide courts in the condition advertised
  • Respond to player inquiries promptly
  • Comply with all applicable laws and regulations

6.4 Subscription and Fees

PickleLobby operates on a subscription model for venue owners. Subscription tiers and pricing are outlined in your owner dashboard. We reserve the right to modify subscription fees with 30 days' notice. Current subscriptions will be honored until the end of the billing period.

During promotional periods, we may offer free access or discounted rates. These promotions may be modified or discontinued at any time.

6.5 Payouts

Booking revenue (minus service fees) will be transferred to your registered bank account according to the payout schedule in your agreement. You are responsible for providing accurate banking information and for any taxes owed on your earnings.

6.6 Cancellations by Owners

If you must cancel a confirmed booking, you must do so as early as possible and refund the player in full. Excessive cancellations may result in penalties, suspension, or removal from the Platform.

7. Prohibited Activities

Users may not:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Engage in fraudulent transactions or identity theft
  • Harass, abuse, or harm other users
  • Scrape, crawl, or extract data from the Platform without permission
  • Circumvent the Platform to arrange direct bookings and avoid fees
  • Create fake accounts or reviews
  • Interfere with the operation of the Platform

8. Intellectual Property

All content on the Platform, including text, graphics, logos, images, software, and design, is the property of HIRE SOLAH ENTERPRISE or its licensors and is protected by Malaysian and international copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our express written permission.

By submitting content (photos, reviews, descriptions) to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the operation of PickleLobby.

9. Disclaimers and Limitation of Liability

9.1 Platform "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

9.2 Venue Responsibility

PickleLobby acts as an intermediary between players and venue owners. We do not own, operate, or control the venues listed on the Platform. Venue owners are solely responsible for the condition of their facilities, safety, and compliance with laws.

9.3 Limitation of Liability

To the maximum extent permitted by Malaysian law, HIRE SOLAH ENTERPRISE and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or RM 100, whichever is greater.

9.4 Injuries and Damages

Pickleball involves physical activity and carries inherent risks. PickleLobby is not liable for any injuries, accidents, or damages that occur at venues. Users participate at their own risk and should ensure they have appropriate insurance coverage.

10. Indemnification

You agree to indemnify, defend, and hold harmless HIRE SOLAH ENTERPRISE and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your venue operations (for owners)

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

11.2 Informal Resolution

Before filing any formal legal action, you agree to first contact us at hi@solahidris.com to attempt to resolve the dispute informally.

11.3 Between Users

Disputes between players and venue owners should be resolved directly between the parties. PickleLobby may assist in facilitating resolution but is not obligated to do so.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or by posting a notice on the Platform. Your continued use of PickleLobby after changes are posted constitutes acceptance of the updated Terms.

The "Last updated" date at the top of this page indicates when these Terms were last revised.

13. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, third parties, or our business interests
  • Is fraudulent or illegal

Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination (including indemnification, disclaimers, and limitations of liability) shall remain in effect.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HIRE SOLAH ENTERPRISE regarding the use of PickleLobby and supersede all prior agreements and understandings.
